State Information
The insurer must establish procedures to protect the confidentiality of a covered person’s insurance policy when a person properly presents themselves as the policyholder against whom protection is obtained. Additionally, the law also mandates that insurers establish procedures to prohibit certain actions against individuals solely based on their status as current or former victims of domestic violence. These protections include important safeguards for victims of domestic violence under §2612 of the New York Insurance Law.
If a person covered by an insurance policy is a child, this right extends to the guardian or parent of the child. During the duration of the policy, the insurer is prohibited from disclosing the telephone number and address of the insured to the policyholder in order to protect the policyholder. Similarly, if another person covered by an insurance policy is issued to the policyholder, the insurer is prohibited from disclosing the telephone number and address of the insured to that person during the duration of the policy in order to protect the policyholder.
