Sam Bankman-Fried’s ex Caroline Ellison faced 110 years in jail before plea

Before she agreed to cooperate with the federal government, Caroline Ellison, the ex-girlfriend of crypto mogul Sam Bankman-Fried from FTX, was facing up to 110 years in prison.

The ex-CEO of Alameda hedge fund, aged 28, admitted to federal fraud charges in a plea deal signed on Monday.

The document filed by the US attorney for the Southern District of New York states that the maximum total sentence for Seven Counts in the Information is 110 years of imprisonment.

It is probable that much less severe sentences will be given in exchange, as the federal authorities have agreed to “fully cooperate” with Ellison and FTX co-founder Gary Wang, suggesting that the agreement encompasses them as well.

Experts suggest that it is impossible to determine the precise amount of time Ellison could have, even in the absence of any time whatsoever.

Ira Lee Sorking, a former lawyer for fraudulent con artist Bernie Madoff, informed The Post that it is currently impossible to predict what she will receive.

“Former federal prosecutor A. Penza Moira mentioned that it is also too early to predict what sentence she may get, but she could potentially just get off with probation.”

The Post informed Penza that it is not uncommon for testifying cooperators, even those facing lengthy sentences like Ms. Ellison, to be granted probation instead of being sentenced to prison.

If she were to end up testifying at the trial against SBF or others, it is evident that she would make even more significant efforts to reduce her sentence and cooperate further. By signaling remorse and taking responsibility at every opportunity, she is indicating that she is truly remorseful and accountable. Ms. Ellison could potentially be at the door as early as she didn’t even need to be indicted.

Federal investigators state that FTX’s customers are owed around $8 billion by Alameda this year, and the hedge fund of Alameda was financed using investors’ funds by Bankman-Fried. FTX experienced a collapse in November.

Ellison was accused of participating in the scheme and faced charges of money laundering, securities fraud, commodities fraud, and wire fraud.

Federal prosecutors usually do not reveal completed deals that have been struck with them before. Once Bankman-Fried’s trial has concluded, it is likely that she has finished cooperating, but the amount of time she will serve in prison will not be announced until then, if she has agreed to serve any.

After being brought back from the Bahamas, Bankman-Fried, her previous lover, is currently residing at his parents’ Palo Alto residence and is wearing an ankle monitor. He was released on an unprecedented $250 million bail bond, which is a thousand times higher than hers.

As part of her plea, Ellison, a native of Massachusetts, was required to surrender her travel documents to law enforcement. Additionally, she is not allowed to travel outside of the continental United States and is also prohibited from teaching at MIT.

The national government has individually filed a lawsuit against Ellison, and Ellison remains responsible for financial losses, as indicated by the plea agreement.

Earlier this week, legal professionals informed The Post about their belief that Ellison would betray Bankman-Fried.

Jack Sharman, a defense attorney specializing in white-collar criminal cases at Lightfoot, Franklin and White, commented, “Although I may not particularly enjoy the tasks I am assigned, ultimately, I must prioritize my own or my family’s welfare; this is a sentiment expressed by people on a regular basis.”

Michael Weinstein, a former federal prosecutor and white-collar defense attorney at Cole Schotz, stated that Ellison and Wang’s actions will likely weaken many of Bankman-Fried’s defenses or arguments suggesting that they were in control or acting without his awareness.
