Manslaughter case for ‘Rust’ movie armorer heads to trial

She was the assistant prop and weapons handler for the movie, with filming in Montana completed since then. Reed Gutierrez, 25, is the sole defendant remaining in the alleged prosecution of wrongdoing in New Mexico.

Earlier this year, prosecutors dismissed the charges of involuntary manslaughter against Baldwin.

Gutierrez Reed, who has entered a plea of not guilty, swiftly became the main target of the felony charges, after being appointed last spring by special prosecutors. It is worth noting that the actor has consistently denied pulling the trigger.

The following week was scheduled to commence a five-day trial that the prosecutors had been getting ready for. The judge was supposed to be convinced by the objective of the trial that there was enough evidence to demonstrate Gutierrez Reed’s criminal negligence. She has been accused of felony involuntary manslaughter and tampering with evidence.

Judge Mary Sommer Marlowe of the 1st Judicial Court in New Mexico refused to grant Gutierrez’s petition to dismiss the charges, scheduling evidence hearings for the following week.

Special Prosecutors Kari T. Morrissey and Jason J. Lewis submitted a roster of 40 potential witnesses, which includes FBI agents, sheriff’s deputies, and various individuals from the ill-fated western movie, during the week-long court proceedings.

However, the plans were altered on Friday.

Barry Massey, the spokesperson for the New Mexico Administrative Office of the Courts, announced in a statement that Hannah Gutierrez has chosen not to have a preliminary hearing in the State v. Hannah Gutierrez case. As a result, the case can now progress to trial since the hearing has been waived.

The intervening stage merely removes the decision made on Friday, which would have advanced the case towards a trial. Defense lawyers appear to accept the fact that prosecutors would probably have succeeded during the hearing.

The special prosecutors accused Reed Gutierrez of smoking marijuana and drinking during off-hours in the western production. They alleged that she probably hung over on the fatal day. Recognizing that her actions would draw scrutiny, they also allege that she gave a small bag of cocaine to a friend after the shooting. This charge relates to tampering with evidence.

Jason Gutierrez, attorney for Bowles, has criticized the prosecution’s efforts, calling the smears against his client unacceptable and stating that prosecutors lack evidence of drug use.

The situation has been plagued by different mistakes by prosecutors and law enforcement.

Baldwin was charged with involuntary manslaughter in late January. However, the criminal charges against Baldwin were dropped in April, along with Lewis Morrissey. The case took a new turn when new information emerged, leading to the dropping of criminal charges against Baldwin and Morrissey in April. Sources have stated that prosecutors received evidence multiple times indicating that the gun had been modified before it was delivered. This supports Baldwin’s long-held contention that he did not pull the trigger.

Prosecutors are awaiting the outcomes of a firearms examination before determining whether to pursue any charges against the distinguished actor.

The veteran film industry defendant, David Halls, accepted an initial arrangement plea and pleaded no contest to a misdemeanor count of negligent use of a deadly weapon. He received a six-month suspended sentence and probation without supervision.

Morrissey and Lewis assumed control of the case in April after the two initial prosecutors were compelled to resign.
